California Slammed with 26 More Strike 3 Holdings Cases

Twenty-six more households in California will be receiving an unexpected notice from their internet service providers (e.g., AT&T, Comcast, Spectrum, Verizon, etc.) notifying them that Strike 3 Holdings is suing them and has subpoenaed their identity. Strike 3 Holdings files thousands of nearly identical lawsuits all across the country alleging that their investigators have observed IP addresses repeatedly downloading their copyrighted films (published under the brands Vixen, Tushy, and Blacked) through BitTorrent networks. They then sue the internet subscriber for damages and subpoena the ISP for the subscriber’s identity in order to serve the defendant. Although plentiful, each lawsuit is serious, with minimum damages reaching into thousands of dollars per alleged infringement.

The only way to stop the release of the information is through a Motion to Quash. This is a court motion that argues that the subpoena should be voided, cancelled, or otherwise “quashed”. Although it sounds simple, Motions to Quash are complicated in these cases as the subpoena is between the Plaintiff and the ISP and the internet subscriber is a third-party.

If you have received one of these letters, it’s important to seek legal counsel without delay. Without action, your ISP is obligated to reveal your identity. If not defended against, the Plaintiff can name the defendant publicly and formally serve the defendant. Once you are served, you typically have 21 days to respond in Federal Court or face a default judgement. Acting quickly can sometimes prevent your identity from being released to the Plaintiff. In other cases, we can argue for a Motion for a Protective Order that can shield your identity from the public.

Strike 3 Holdings Files 52 More BitTorrent Cases in California

Strike 3 Holdings, one of the largest filers of online copyright infringement lawsuits in the United States, has filed 52 more lawsuits in California over just 5 weeks. The reason why Strike 3 Holdings can file so many lawsuits in such a short period of time is because each lawsuit is nearly identical.

Strike 3 owns the rights to several adult film brands, including Vixen, Tushy, Blacked, and Blacked Raw. It claims that it uses an overseas investigator to monitor BitTorrent traffic. The investigators record each IP address that they observe sharing one of Strike 3’s films. They then file a lawsuit against the internet subscriber to which the IP address is assigned. It argues that in order to properly name and serve the complaint on the defendant, it needs to subpoena the identity of the internet subscriber from the Internet Service Provider (e.g., Comcast, Verizon, Optimum Online, Time Warner, etc.).

Many people first discover the lawsuit when they receive a notice from their ISP that Strike 3 Holdings has subpoenaed their identity. As the subpoena acts like a court order, the only way to fight it is through filing a Motion to Quash. Motions to Quash are complicated in these cases as the subpoena is between the Plaintiff and the ISP, meaning the internet subscriber is a third party.

These notices are serious. If you do not respond, your ISP is obligated to provide your identity to the Plaintiff, which allows them to serve you with a summons and complaint. Once you are served, you typically have 21 days to respond in Federal court. If you do not respond to the complaint in court, the Plaintiff can ask for a default judgement, where damages can be in the $1,000s per infringement plus attorneys fees and costs.

Strike 3 Holdings Files 133 new cases in California

Reddit user /u/beardfearer may fear beards, but not copyright noticesStrike 3 Holdings was active over the holiday season, filing 133 new copyright infringement lawsuits in California. This represents approximately 2 lawsuits every day. Although each lawsuit is against a different internet subscriber, the allegations are nearly identical in each case. The Plaintiff alleges an IP address was used to download and share the Plaintiff’s adult films (marketed under the Tushy, Vixen, Blacked, and Blacked Raw brands) through BitTorrent networks.

They then sue each unnamed internet subscriber as a “John Doe”, identified only through an IP address. They then request the courts to grant a subpoena to the subscriber’s internet service provider (ISP) so they can learn the user’s identity. Once identified, they serve the Defendant with a summons that must be answered in court or the Defendant could face a default judgement against them.

Often, a defendant first discovers the lawsuit when they receive a letter from their ISP notifying them of the subpoena and the possibility to file a motion to quash. It is important to begin an effective defense at this stage. Securing representation early can provide you with more options to protect your identity and fight the allegations.
