Criminal Productions lawsuit discovery begins in Pennsylvania

“Criminal” (IMDB: 6.3/10; Ebert: 1/4) is an action movie released in April of 2016 about transferring the mind of a deceased person into another brain.

In a remarkably similar fashion, the movie’s owners have transferred the mind of a plaintiff’s attorney into their new counselor, former copyright defense attorney Charlie Thomas.

Atty Thomas has filed a John Doe lawsuit against five unknown defendants on behalf of the Plaintiff, seeking both their identity and liability for alleged illegal downloads of Plaintiff’s movie. Like many other file-sharing cases in 2016, the Plaintiff alleges that this infringement was committed via the bittorrent protocol. Bittorrent is well known for sharing as it downloads, exposing defendants’ IP addresses to tracking by plaintiffs’ investigators.

Judge Cynthia Rufe recently granted Atty Thomas’ subpoena request for subscribers’ identities. Those subscribers can expect to begin receiving notices of the subpoenas from their service providers shortly, if not already. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.

Malibu Media Lawsuits Resume on Long Island

Last October, Eastern District of New York Magistrate Judge Stephen I. Locke  stayed all Malibu Media lawsuit discovery pending the outcome of a Motion to Quash filed by one of the defendants.

That Defendant’s Motion to Quash has since been denied and the stay has been lifted as of August 23rd, 2016. Subpoena notices are already making their way to defendants.

Judge Locke cited all the usual reasons for denying Motions to Quash in Malibu Media cases.  The defendant isn’t the recipient of the subpoena, and therefore doesn’t have standing, and even if they did, that the subpoena is not an undue burden, and that defendant’s identity is not privileged or confidential information.

The ruling means that the Eastern District of New York is yet another forum that allows Malibu Media lawsuits to proceed far enough to encourage settlements.

Malibu Media lawsuits resume in NJ with 29 new cases

Malibu Media has filed 29 new federal copyright lawsuits after a five month hiatus. No, not a relaxing vacation for the largest filer of new copyright litigation in history. Rather, (allegedly) a long-brewing dispute over money became a sticking point between Malibu’s owners and their (now former) attorney, Keith Lipscomb. That dispute seems be mostly about Lipscomb’s representation and retention of client funds.

These new lawsuits mirror the same tactics used in the previous operation, demanding compensation for copyright infringement, not sharing or distribution, and accumulating at least a dozen infringements before suit.

Defendants in the newest of these lawsuits can expect to begin receiving notices of the subpoenas from their service providers shortly, in not already. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.
