New York and New Jersey Hit with 34 New Strike 3 Holdings Lawsuits

Strike 3 Holdings has filed 34 new federal copyright lawsuits in New Jersey (22 cases) and New York (12 cases) over the span of just a few days.  Strike 3 owns the rights to adult films marketed under the Tushy, Vixen, and Blacked brands, and is one of the most prolific copyright plaintiffs in the country.

They’re able to file so many lawsuits because each suit is nearly identical, except for the IP address and the specifics of the downloaded films. In each case, they allege that an investigator observed an IP address downloading their films through BitTorrent networks. They then allege that the internet subscriber associated with the IP address must be the alleged infringer. This is a tenuous argument at best as there are many reasons why the subscriber might not be the infringer (e.g., someone else had access to the internet, such as a guest or through unprotected wifi). However, Federal judges routinely grant subpoenas to force internet service providers (e.g., Atlantic Broadband, Charter, Comcast, Frontier, Spectrum, etc.) to reveal the name of the accused internet subscriber.

Many of these Federal cases first began in county court in Miami-Dade, Florida, where Strike 3 first made these allegations and asked for a subpoena. Many people chose to fight that subpoena using a Motion to Quash (i.e., a motion to cancel or “quash” the subpoena) because the case was filed in a court that lacked jurisdiction over copyright matters or non-Florida residents. Strike 3 routinely dismisses these people from the Florida-based case; however, the case is rarely over, as Strike 3 goes on to file a Federal case in what is likely the correct jurisdiction, which makes filing a Motion to Quash more complex.

Strike 3 Files 21 New Federal Cases in Pennsylvania

Strike 3 Holdings, one of the most prolific filers of copyright infringement lawsuits, has recently focused their attentions on Pennsylvania, filing 21 new Federal cases within a week. Strike 3 owns the rights to adult films marketed under the Tushy, Vixen, and Blacked brands.

Strike 3 Continues to File Federal Lawsuits Across the Country

Strike 3 Holdings is one of the most prolific filers of copyright infringement cases, requesting thousands of identities of anonymous internet subscribers through subpoenas to internet service providers (e.g., Atlantic Broadband, Comcast, Cox, Charter, Frontier, Spectrum, RCN, etc.). They claim their investigators have observed various IP addresses downloading Strike 3’s films (marketed under the Tushy, Vixen, and Blacked brands) through BitTorrent networks.

However, filing a Federal lawsuit against each subscriber is costly. Recently, they’ve started to request dozens – sometimes more than 100 – identities at a time using a Bill of Pure Discovery, filed in Miami-Dade Florida. Many people first find out about the case when they receive a notice of the subpoena through their ISP, and are told about a Motion to Quash. This is a a type of motion to cancel or “quash” the subpoena. The case for a Motion to Quash is strong in Florida, particularly because state courts do not have jurisdiction over copyright matters, and because most of the subscribers are not Florida residents.

Strike 3 has typically dismissed the case against anyone who files a Motion to Quash in Florida state court, but it appears this is only a temporary reprieve, as they are now filing dozens of Federal lawsuits, including against people who were dismissed from a former Miami-Dade lawsuit.

Strike 3 has already filed 23 Federal cases in October alone,  meaning they’re filing an average of 2 per day. They’ve filed across the country, including California (8 cases), Illinois (1 case), Florida (3 cases), Maryland (9 cases), Michigan (1 case), and New York (1 case).

The argument for a Motion to Quash is more complex in Federal cases as the case is often filed in the correct jurisdiction. If you’re considering a Motion to Quash, please contact me.
