Malibu Media lawsuit failures – aka: You can fight Malibu and win

"Before us in this copyright infringement action are cross- motions for summary judgment. Because we find that the plaintiff has failed to (1) make a prima facie case of copyright infringement and (2) show that evidence allegedly spoliated was relevant to its claim, we will deny plaintiff's motion for summary judgment and grant defendant's pro se motion for summary judgment."
Case 14-1280 E.D.P.A.

Hello everyone. It’s been a little while since the last Malibu case update. I’ve been quite busy helping people both settle and litigate Malibu cases.

This post is to update you on two recent, notable cases where the reach of Malibu Media lawsuits has been limited by the courts. In any federal civil case, the parties are entitled to certain amount of discovery of relevant evidence, governed, of course, by the judge. In the past, judges have granted Malibu very broad discovery, often allowing depositions and evidence gathering from friends and family.

Here are two cases where the judge chose tighter limits:

The first case is out of the Eastern District of Pennsylvania. You may recall that Malibu Media’s first “trial” was held in the very same district. Judge Stewart Dalzell ruled on cross summary judgement motions that Malibu had not found any evidence of actual infringement and granted the pro se defendant’s motion against Malibu. The case is number 14-1280.

This confirms that Malibu does have to prove the evidence exists in order to prove their case. Malibu cases can be won; defendants, under the right circumstances, can confidently challenge their case and make Malibu prove their claims.

The second case, which everyone is writing about, is remarkable for the fact that Judge Katherine Forrest, SDNY, has limited the discovery of evidence to just the defendant, and not the defendant’s family and neighbors. In discovery of evidence, judges have the discretion to grant broad discovery and/or set limitations on it. Judge Forrest ruled that Malibu’s accusation limits who they can pursue, and that pursuit of the defendant through deposing his family and neighbors amounts to harassment/embarrasment. The discovery was denied. This doesn’t end the case, but it means judges are watching.

So, lessons learned:

  1. You *can* fight Malibu Media lawsuits. Should you? That’s where you will need individual legal advice.
  2. Fighting the lawsuit doesn’t mean Malibu Media automatically gets access to your friends and family. This, too, is where you will need competent representation.

If you or someone you know has received notice of a Malibu Media lawsuit, please call me immediately at 888-801-8681. I will be happy to speak to you myself and discuss your options. I charge fair, flat rates for most of my services, and work with my clients who need hourly representation to make the matter as affordable as possible.

Thank you for reading, and,  as always, I am,
Yours, truly,
Leonard French, Esq.

Now with Siterips: New Malibu Media lawsuits filed in Pennsylvania

Reddit user /u/beardfearer may fear beards, but not copyright noticesEveryone’s favorite copyright Plaintiff, Malibu Media, filed 13 new lawsuits in Pennsylvania at the end of April, renewing its presence in the Keystone State after over six months of absence.

Instead of alleging many downloads over a period of time (sometimes years), these suits claim a “siterip”, or collection, of titles was downloaded. A spot check of the docket reveals that the cases each refer to the same siterip of 127 titles. These are the first “siterip” cases for Malibu Media in memory.

Malibu Media and their attorneys are behind the greatest lawsuit machine of all time, churning out 703 new Federal Copyright Lawsuits so far in 2015 alone, and more than 4,000 over the past three years. Plaintiffs are represented by Keith Lipscomb of Lipscomb, Eisenberg, and Baker, of Miami, FL, with local Pennsylvania counsel being provided by Chris Fiore of Fiore and Barber, in Philadelphia. Malibu is the owner of X-Art.com, an adult entertainment website.

Defendants in these new Malibu Media lawsuits can expect to begin receiving notices of the subpoenas from their service providers in the middle of May. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.

If you have received a notice in one of these cases, please don’t hesitate to call me immediately at 888.801.8681. If calling after-hours, please leave a message; I do return calls after-hours.

I have a ton of experience in file-sharing lawsuits and can help you achieve the best outcome possible. I’ve written a subpoena defense guide for your information, as well.

I look forward to speaking with you and helping you put this matter behind you.

Yours,
Leonard French

Reddit user /u/beardfearer may fear beards, but not copyright notices

A new copyright Plaintiff, Glacier Films, has begun filing lawsuits in Illinois’ Northern District Court. Seven lawsuits were filed, each against multiple John Does, and each for the alleged unauthorized download of Plaintiff’s film, “American Heist”.

The Plaintiffs are represented by Michael A. Hierl and Todd Sheldon Parkhurst  of Hughes Socol Piers Resnick & Dym Ltd.

Each case joins defendants en masse, with the Does ranging from 13 to 34.

Defendants in these new cases are likely to receive their notice of subpoenas to their internet service providers within the next few weeks. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.
