In just 10 days, Strike 3 Holdings and Malibu Media have already filed 123 new copyright infringement lawsuits in just 6 states: Connecticut, Maryland, Michigan, New Jersey, New York, and Pennsylvania.

These plaintiffs are known for suing IP addresses they allege used Bittorrent to illegally downloaded their movies, often with many infringements per IP The online nature of the alleged infringement presents a challenge to defendants wishing to put forth a full legal defense. Defendants often find the litigation more complicated, protracted, and expensive, than a simple case of file-sharing would initially seem.address.

Together, Strike 3 Holdings and Malibu Media have filed more than a dozen lawsuits a day across just 6 states.

Nationwide Explosion of Online Piracy Bittorrent Lawsuits is 50% of new Copyright Litigation

2018 has seen a huge increase in new copyright litigation being filed against anonymous “John Doe” defendants who are accused of downloading movies and videos via file-sharing or Bittorrent-based software. Approximately 1450 new bittorrent lawsuits have been filed in 2018 so far.

This represents over 50% of new copyright litigation in the United States at this time.

80 New ME2 Productions Lawsuits filed in 2017

The new year has brought an uptick in new copyright litigation filed against anonymous internet users, usually because of the online nature of the infringement.

John Doe copyright lawsuits represent 320 of 793 new filings for the entire Federal Circuit.

Two Plaintiffs, Malibu Media and ME2 Productions, are responsible for over 35% of the new cases, with ME2 Productions filing 80 alone.

The online nature of the alleged infringement presents a challenge to defendants wishing to put forth a full legal defense. Defendants often find the litigation to more complicated and protracted than a simple case of file-sharing would initially seem.

The United States has seen a rise in this kind of litigation as more and more Plaintiffs learn how to monetize allegations of online copyright infringement.

Defendants’ first notice of a case is usually a Letter from their Internet Service Provider notifying them that the Plaintiff is seeking their identity. If the case is not resolved there, the Plaintiff usually serves the Defendant with a Summons to respond in Federal District court.
