Criminal Productions lawsuit discovery begins in Pennsylvania

“Criminal” (IMDB: 6.3/10; Ebert: 1/4) is an action movie released in April of 2016 about transferring the mind of a deceased person into another brain.

In a remarkably similar fashion, the movie’s owners have transferred the mind of a plaintiff’s attorney into their new counselor, former copyright defense attorney Charlie Thomas.

Atty Thomas has filed a John Doe lawsuit against five unknown defendants on behalf of the Plaintiff, seeking both their identity and liability for alleged illegal downloads of Plaintiff’s movie. Like many other file-sharing cases in 2016, the Plaintiff alleges that this infringement was committed via the bittorrent protocol. Bittorrent is well known for sharing as it downloads, exposing defendants’ IP addresses to tracking by plaintiffs’ investigators.

Judge Cynthia Rufe recently granted Atty Thomas’ subpoena request for subscribers’ identities. Those subscribers can expect to begin receiving notices of the subpoenas from their service providers shortly, if not already. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.

15 Malibu Media lawsuits dismissed in California due to untimely filings

FightCopyrightTrolls.com reports that Malibu has recently lost fifteen lawsuits in California due to untimely filings. Malibu has filed over 433 lawsuits so far this year (2016).

You may know that Judges often have discretion to allow parties some leeway in the procedural execution of a court case. Malibu’s cases are numerous, and Federal Civil Procedure is well established.

Malibu Media’s attorneys, some of whom seem to be responsible for hundreds of cases at a time, filed motions for time extensions just a little bit too late.

Judge William Alsup, of the Northern District of California, exercised his discretion. He denied the extensions of time to serve summons on the defendants. And, since there is now no way to comply to with the service rules, he dismissed the cases.

As an added bonus, Judge Alsup also set some local precedent, which may be good form for future filings: “Counsel should have acted promptly and diligently, and going forward, plaintiff must seek leave to serve such subpoenas within the first thirty days after a case is filed.”

Malibu Media, LLC, owner of the X-Art.com adult website, continues to file a record-setting number of lawsuits around the United States, taking advantage of copyright laws which currently favor plaintiffs. In Illinois’ Northern District, 29 new lawsuits were filed in February of 2016.

Defendants in the newest of these Malibu Media lawsuits can expect to begin receiving notices of the subpoenas from their service providers in the beginning of March, if they haven’t already. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.
