35 New File-Sharing Lawsuits filed in Maryland (Malibu Media, Strike 3 Holdings)

The new year has brought an uptick in new copyright litigation filed against anonymous internet users, with over 442 new “John Doe” copyright lawsuits filed since the Jan 1st .

John Doe copyright lawsuits accounted for 716 of 3680 new copyright filings for the entire Federal Circuit in 2017, representing approximately 20% of all new copyright litigation.

The new Plaintiff, Strike 3 Holdings, alleges violations involving adult videos. This is their first round of lawsuits in New Jersey.

The online nature of the alleged infringement presents a challenge to defendants wishing to put forth a full legal defense. Defendants often find the litigation to more complicated, protracted, and expensive, than a simple case of file-sharing would initially seem.

The United States has seen a rise in this kind of litigation as more and more Plaintiffs learn how to monetize allegations of online copyright infringement.

Defendants’ first notice of a case is usually a Letter from their Internet Service Provider notifying them that the Plaintiff is seeking their identity. If the case is not resolved there, the Plaintiff usually serves the Defendant with a Summons to respond in Federal District court.

34 new Malibu Media lawsuits in Maryland for March/April 2016

Malibu Media has filed 34 new federal copyright lawsuits in Maryland over alleged illegal downloading.

Malibu Media, owner of the adult entertainment website X-Art.com, has filed approximately 5,000 lawsuits around the county in the last four years alone., and 433 so far this year. These newest 34 are just a continuation of that trend.

Defendants in the newest of these lawsuits can expect to begin receiving notices of the subpoenas from their service providers shortly, in not already. These subpoenas seek the subscribers’ names and addresses. Plaintiffs typically use the identities to pursue settlements or further litigation.

15 Malibu Media lawsuits dismissed in California due to untimely filings

FightCopyrightTrolls.com reports that Malibu has recently lost fifteen lawsuits in California due to untimely filings. Malibu has filed over 433 lawsuits so far this year (2016).

You may know that Judges often have discretion to allow parties some leeway in the procedural execution of a court case. Malibu’s cases are numerous, and Federal Civil Procedure is well established.

Malibu Media’s attorneys, some of whom seem to be responsible for hundreds of cases at a time, filed motions for time extensions just a little bit too late.

Judge William Alsup, of the Northern District of California, exercised his discretion. He denied the extensions of time to serve summons on the defendants. And, since there is now no way to comply to with the service rules, he dismissed the cases.

As an added bonus, Judge Alsup also set some local precedent, which may be good form for future filings: “Counsel should have acted promptly and diligently, and going forward, plaintiff must seek leave to serve such subpoenas within the first thirty days after a case is filed.”
