What has Strike 3 Filed?
Notorious Plaintiff Strike 3 Holdings is known for filing 1,000s of federal lawsuits every year against anonymous Bittorent users (known as John Does). Although they have traditionally focused on larger states such as New York, Florida, and California. In June, they branched out to include Hawaii and Tennessee. Since July, they have filed 24 cases in Hawaii and 10 cases in Tennessee. This is part of a nationwide blitz of more than 1,000 cases filed in the past few months.
Normally, handling so many lawsuits at once would be a daunting task, but it’s standard practice for Strike 3. Each lawsuit is nearly identical, usually filed by Attorney Christian Kamau in Hawaii or Attorneys Jacqueline James and Dawn Sciarrino in Tennessee, and alleges that an investigator recorded an IP address infringing on Strike 3’s copyrights by downloading Vixen, Tushy, or Blacked films through BitTorrent networks. Strike 3 then asks the court to grant a subpoena for the name of the internet account holder behind the IP address.
Motions to Quash
When an internet service provider, such as AT&T U-verse, Hawaiian Telcom, Comcast, or Spectrum, receives the subpoena, they’re obligated to alert the subscriber. This is when most people find out about the lawsuit and the need to file a Motion to Quash to challenge the subpoena.
