Nationwide Explosion of Online Piracy Bittorrent Lawsuits is 50% of new Copyright Litigation

2018 has seen a huge increase in new copyright litigation being filed against anonymous “John Doe” defendants who are accused of downloading movies and videos via file-sharing or Bittorrent-based software. Approximately 1450 new bittorrent lawsuits have been filed in 2018 so far.

This represents over 50% of new copyright litigation in the United States at this time.

15 Malibu Media lawsuits dismissed in California due to untimely filings

FightCopyrightTrolls.com reports that Malibu has recently lost fifteen lawsuits in California due to untimely filings. Malibu has filed over 433 lawsuits so far this year (2016).

You may know that Judges often have discretion to allow parties some leeway in the procedural execution of a court case. Malibu’s cases are numerous, and Federal Civil Procedure is well established.

Malibu Media’s attorneys, some of whom seem to be responsible for hundreds of cases at a time, filed motions for time extensions just a little bit too late.

Judge William Alsup, of the Northern District of California, exercised his discretion. He denied the extensions of time to serve summons on the defendants. And, since there is now no way to comply to with the service rules, he dismissed the cases.

As an added bonus, Judge Alsup also set some local precedent, which may be good form for future filings: “Counsel should have acted promptly and diligently, and going forward, plaintiff must seek leave to serve such subpoenas within the first thirty days after a case is filed.”

I’m marking this post for all jurisdictions because it highlights the importance of experienced legal counsel. UPDATED to include most recent Pennsylvania filings.

ORIGINAL: At least 50 new copyright lawsuits by a new Plaintiff in the bittorrent arena were filed by  “Plastic the Movie” in Florida and Pennsylvania on Friday.

The cases each allege a single infringement: a British action flick receiving a whopping 32/100 on metacritic.com (I swear there’s a pattern here).

The 40 cases in Florida and 10 filed in Pennsylvania leave little doubt that this is the beginning of a wave of filing for our new UK-based Plaintiff.

Defendants can expect to receive notices of Plastic the Movie subpoenas to their ISPs within the next few weeks, depending on the judge handling each case.
